Having problems with your 2008 Chevrolet Aveo5 ?

2008 Chevy Aveo dash board light and shifter indicator light not working the Aveo is in the repair shop for the 3 time and it is over 30 business days in the repair shop it is under warranty and ready to be declare a lemon. The defect came with the car. Should I declare it a lemon? Tech keep ordering various parts and it is shorting out. Should I declare it a lemon.
